What the Swiss Telecommunications Act and the revised Data Protection Act mean for your cookie banner — and how the FDPIC reads them.

Cookie law
Fernmeldegesetz / Loi sur les télécommunications (Telecommunications Act), Art. 45c(b); revised Federal Act on Data Protection (FADP), in force since 1 September 2023
Banner languages
German, French, Italian, Romansh
Maximum fine
Criminal fines of up to CHF 250,000 for specific intentional offences under the FADP, imposed mainly on responsible individuals.
Switzerland works differently: the Telecommunications Act requires information and a way to refuse, not blanket prior consent. Consent becomes necessary in specific cases, such as high-risk profiling.
What the rules say
- Art. 45c(b) requires information about the processing and its purpose, plus notice of the option to refuse.
- The revised FADP also applies when cookies process data about identifiable people.
- Where consent is needed for sensitive data or high-risk profiling, it must be explicit.
- Cross-site advertising tracking may need consent where it enables high-risk profiling.
- Location-based profiling often counts as high-risk profiling, according to the FDPIC.
How PrivacyPill handles this
- Nothing optional runs before a choice. Google tags start with Consent Mode v2 set to denied; other scripts marked with data-pp-category wait until their category is allowed.
- Equal first-layer buttons. "Accept all" and "Reject non-essential" sit side by side with the same weight, and a settings button lets visitors withdraw consent at any time.
- Consent per purpose. Analytics, marketing and functional cookies can be allowed separately in the preferences panel.
- Languages. The banner ships in German, French, Italian. Romansh isn't built in yet — rewrite the English texts in the customizer to show your own translation.
- Proof of consent. Every choice is logged pseudonymously with the banner version, exportable as CSV.
